2. Agreeing to use the service

You must have an opportunity to review these terms and service details before registration or purchase. Anyone accepting for an organisation confirms authority to do so.

Users under 18 need appropriate parent, guardian or institutional authorisation. A learner’s platform use does not itself authorise charges to another person or school.

3. Accounts and access

Provide accurate information, protect credentials and promptly report suspected unauthorised access. Features and records depend on role, institutional status, subscription and permissions.

Schools must appoint authorised administrators. Family links must identify the correct learner and reflect lawful access rights and relevant court orders. Promptly report unexpected access to another person’s information.

4. School and user responsibilities

Schools remain responsible for educational operations, staff appointments, assessments, safeguarding and statutory records. Schools and users must ensure information is accurate, lawfully collected and appropriately shared.

Teachers must review grades, reports and learning materials before issuing them. Learners must follow academic integrity rules. Platform use does not transfer educational or legal responsibilities to Lunge.

5. Plans, subscriptions and charges

Before purchase, the offer or agreement must identify the customer and payer; included features and limits; separate services; full price, taxes and additional fees; billing period, activation and payment method; renewal and cancellation; and setup, migration, training or support charges.

School, individual and external tutoring subscriptions may be separate. Recurring payments require appropriate authorisation. Price changes must be disclosed before applying, and fixed-price commitments honoured. Trial duration, limitations and any conversion to paid access must be explained before registration.

6. Cancellation, renewal and refunds

Monthly cancellation ordinarily stops the next renewal, with access until the paid period ends. This does not limit statutory rights to earlier cancellation, refunds or other remedies. We do not apply a blanket no-refunds policy.

Where Consumer Protection Act section 14 applies, a consumer may cancel a fixed-term agreement on 20 business days’ written or recorded notice. Any cancellation charge must be reasonable and lawful. Applicable expiry notices and renewal requirements must be observed.

Where an online purchase qualifies under the Electronic Communications and Transactions Act, applicable cooling-off rights apply. For qualifying services this is generally seven days after agreement, subject to statutory exceptions. Starting services during that period must be explained and appropriately authorised.

Billing errors, duplicate charges and services not supplied as agreed will be investigated and appropriate remedies provided. Send cancellation requests to info@lunge.co.za or submit a cancellation request through your Netademix institution administrator settings. Cancellation and information deletion are separate processes.

7. Independent tutoring

External tutoring may require a separate subscription. Before payment, the authorised payer must receive the tutor’s identity, service scope, fees, scheduling and cancellation, rescheduling and refund arrangements.

Independent tutors are responsible for teaching, conduct and represented qualifications. Lunge must accurately describe any verification; approval does not guarantee results. Commissions, revenue shares and payouts belong in a separate tutor agreement.

Report safeguarding concerns promptly to the school and Lunge, and appropriate authorities where necessary.

8. Live classes and recordings

Tools depend on institutional setup and the connected video service. Respect privacy: do not distribute meeting links, record or share recordings without permission and lawful authority.

The institution must ensure appropriate notice and required authorisation before recording, explaining purpose, access and retention. Recording and playback are only available where included and enabled, and are not guaranteed for every session.

9. Transport and location features

Transport tools depend on configured routes, vehicles, devices, connectivity and location data. Locations and arrival estimates may be delayed or inaccurate. Schools, operators and drivers remain responsible for safe transport, supervision and collection.

Do not disclose routes or locations to unauthorised people. Location processing needs an appropriate lawful basis and notice. For urgent safety concerns, contact the school or operator and emergency services as appropriate.

10. User content and school records

You retain your rights in uploaded materials. Personal information remains subject to the rights of the people concerned and applicable law. You grant Lunge limited permission to host, process, display and transmit materials to deliver the agreed service.

This does not permit publishing private school records or using learner work in advertising. You must have rights or authority to upload materials. Do not upload unlawful, malicious or infringing content.

11. Personal information and children

Lunge and institutions must identify their respective POPIA responsibilities. Operator processing on school instructions requires an appropriate written agreement. Where Lunge determines its own purposes, it must meet corresponding obligations.

Children’s information requires particular protection and a lawful basis, including competent-person consent where required. Our Privacy Policy and institutional agreement must explain processing, providers, transfers, security, retention and rights; these terms do not replace them.

12. Acceptable conduct

Do not bully, threaten, discriminate, exploit or harass. Do not misuse records, impersonate users, interfere with assessments or bypass security. Lunge may reasonably restrict harmful content or access, considering learner welfare, evidence preservation and law.

13. Automated assistance

Automated or AI-assisted outputs may contain errors and require review. Authorised staff retain responsibility for final educational, administrative and safeguarding decisions. Suggestions do not guarantee assessment accuracy or replace professional judgement.

Submit personal information only where the relevant processing is disclosed and lawfully authorised.

14. Availability, support and changes

We will provide services with reasonable care and skill. Maintenance, connectivity, providers and faults may affect availability. Guaranteed uptime, support hours and response times require a separate service agreement.

We will give reasonable notice of planned material disruption where practicable. If a material change substantially reduces a paid service, we will discuss an appropriate remedy and honour cancellation and refund rights.

15. Suspension and termination

Access may be restricted where reasonably necessary for security threats, unlawful activity, serious misuse or payment default. Where practicable and required, we will explain the issue and allow it to be resolved. Urgent restrictions may protect people, information or systems.

Legally required breach notices and remedy periods apply. Suspension does not transfer ownership of materials or remove statutory access rights.

16. Records when the service ends

The school and Lunge should agree an orderly transition, including authorised exports, formats, timing and previously disclosed charges. Schools retain recordkeeping duties. Lunge will handle retention and deletion under law, the Privacy Policy and institutional agreement.

Cancellation does not necessarily require immediate deletion of records that must lawfully be retained.

17. Liability and statutory rights

Lunge is responsible for contractual and legal obligations; institutions and users remain responsible for their own conduct and duties. Netademix does not guarantee examination results, uninterrupted connectivity or independent provider performance. Lunge remains responsible for its own service failures.

Nothing excludes liability that cannot lawfully be excluded, including fraud, gross negligence or mandatory remedies. This agreement proposes no general financial liability cap. Any institutional cap should be negotiated and legally reviewed.

18. Complaints, updates and governing law

Send service or billing complaints to info@lunge.co.za. For school record corrections, also contact the school. Material subscription changes must be communicated before effect, with further agreement where required.

South African law applies subject to mandatory customer protections. Nothing prevents access to a competent court or regulator.
